一名艾滋病病毒感染者致中国保险监督管理委员会的公开信

李伟(化名)是一名艾滋病病毒感染者。他感染艾滋病病毒已经有4年了,但至今身体、工作和精神状态都非常良好。李伟于2008年春节来临之际,向某保险公司购买了一份意外伤害保险,以应对不可预知的意外。之后,他发现所购保险合同中免责条款的第六条和第九条,将"患艾滋病或感染艾滋病期间"与战争、军事行动、暴乱、武装叛乱及核辐射并列的作为免责条件之一。 李伟认为,这些条款明显带有对中国艾滋病感染者和病人这个群体的歧视。 因为感染艾滋病病毒与发生意外伤害之间毫无联系,所以他和中国的约70万艾滋病病毒感染者应该与普通人一样享有正常的理赔待遇。

基于此,李伟经再三思考,决定将这家保险公司告上法庭,要求该公司删除其带有歧视性的保险条款,并公开向他道歉和给与一定的赔偿。他希望通过法律的途径为自己、更为中国的70万感染者和病人争取他们应该享有的公民权利和社会公平地位。


Li Wei has been a PLWHA for 4 years, and I am in excellent physical and mental conditions. He purchased an accidental insurance package with an insurance company when Spring Festival was coming in 2008. He found afterwards by chance in its sixth and ninth accidental disability liability exempt clauses by listing "During the period in which the insurant develops AIDS or is being tested as HIV+" as an equal condition to war, military operations, riot, armed rebellion, and nuclear radiation. This contract casts apparent prejudice and stigma, and severely harms the feelings to PLWHA. The injury and medical compensation for traffic accidents should be linked by no means to the nationality, race, sex, and history of disease of the insurant. There is no linkage between being HIV+ and the chance of encountering a traffic accident. Thus, if a PLWHA is unfortunately involved in a traffic accident, s/he is as eligible for compensation from an insurance company as anyone else.

中国保险监督管理委员会:

我是一名普通的投保人,同时也是一名艾滋病病毒感染者。 2008年2月4日,我在云南省昆明市向中国平安人寿保险股份有限公司云南分公司的业务员购买了卡号为010082000133750(保单号为PC1600W006595939)和卡号为0100882000133749(保单号为PC1600W006595924)的自助保险卡系列"金祝福卡"两份。之后我偶然中发现购买的保险卡的保险条款"责任免除"中写有"因下列情形之一,造成被保险人身故、残疾或医疗费用支出的,本公司不负给付保险责任.....被保险人患艾滋病(AIDS)或感染艾滋病毒(HIV呈阳性)期间"。作为一名艾滋病病毒感染者,按照该保险合同条款我自始就无法享有购买保险应取得的合法权益,也无法通过变更 保险和退保减少损失。

我感染艾滋病病毒已经四年多了,至今身体、工作和精神状态均与常人无异。根据《中国艾滋病防治联合评估报告(2007年)》公布的数字,截至2007年底我国现有艾滋病感染者和病人约70万,同时报告也阐明艾滋病病毒感染者完全可以作为一个正常人工作、生活、学习、组建家庭甚至养育后代,和其他人社会成员一样,有社会和经济生活中平等的参与权利。

在国家颁布的《中华人民共和国传染病防治法》和《艾滋病防治条例》中,均以法律条文的形式载明对艾滋病感染者和艾滋病病人不

得进行歧视,这也正体现了在构建和谐社会中,党和政府对艾滋病感染者和艾滋病病人的关怀及对其平等社会权利的确认与保护。《艾滋病防治条例》中有以下规定:"任何单位和个人不得歧视艾滋病病毒感染者、艾滋病病人及其家属。艾滋病病毒感染者、艾滋病病人及其家属享有的婚姻、就业、就医、入学等合法权益受法律保护。"(第一章第三条)" 地方各级人民政府和政府有关部门应当组织开展艾滋病防治以及关怀和不歧视艾滋病病毒感染者、艾滋病病人及其家属的宣传教育,提倡健康文明的生活方式,营造良好的艾滋病防治的社会环境。"(第二章第十条),条例中明确地提出了对艾滋病感染者和艾滋病病人的合法权益进行保护。

"金祝福卡"中涉及的交通意外伤害保险责任,与被保险人的民族、种族、性别、疾病是没有任何关系的。众所周知,如果一名艾滋病感染者发生交通意外,与其是否感染艾滋病病毒是毫无内在联系的,艾滋病病毒感染者本应该享有与一般的被保险人相同的意外伤害保险权益。在医学上艾滋病只是一种普通的传染性疾病,《中华人民共和国传染病防治法》规定,法定报告的传染病病种分甲类、乙类和丙类,共计35种。艾滋病是22种乙类传染病中的一种,还有比乙类传染病传染性更强的甲类传染病。中国平安人寿保险股份有限公司不仅在其单方面提供的保险合同条款中,将这70万艾滋病病毒感染者和艾滋病病人无理地排除在意外伤害保险责任之外,而且竟然在保险条款中将"患艾滋病或感染艾滋病毒期间"与战争、军事行动、暴乱、武装叛乱及核辐射等并列地作为免责条件之一,明显带有对艾滋病病

毒感染者和艾滋病病人的歧视,严重地伤害了艾滋病病毒感染者和艾滋病病人的感情,也违反了《中华人民共和国传染病防治法》、《艾滋病防治条例》中不得歧视艾滋病感染者和艾滋病病人的相关规定。

综上所述,中国平安人寿保险股份有限公司"金祝福卡"的保险合同条款是对艾滋病病毒感染者和艾滋病病人赤裸裸的歧视。为此,我要求中国平安人寿保险股份有限公司立即删除其保险合同中上述带有明显歧视性和违背法律精神的条款。作为保险行业行政监督和管理部门,我希望保监会能够切实行使有效的管理、监督职能,核查中国平安人寿保险股份有限公司及其它保险公司对艾滋病感染者和艾滋病病人有歧视性的保险合同条款,还70万艾滋病感染者和艾滋病病人一个平等、公平的保险合同!

An Open Letter to China Insurance Regulatory Commission

China Insurance Regulatory Commission:

I am a customer of Ping'an Insurance Company of China, and I am a Person Living with HIV/AIDS (PLWHA) at the same time. On February 4, 2008 in Kunming, I bought from an agent of Pin'an Life Insurance Branch Company in Yunnan two Accidental Insurance Cards named as Jinzhufu (Golden Bless Card, literally) with respective serial numbers as 010082000133750 (Contract Number: PC1600W006595939) and 0100882000133749 (Contract Number: PC1600W006595924). I found afterwards by chance in its sixth accidental disability liability exempt clauses:

"The insurer will be exempted from the liability to pay the accidental injury liability in any of the following circumstances: ......

(6) during the period in which the insurant develops AIDS or is being tested as HIV+;" ...

and in the accidental medical costs liability exempt clauses:

"The insurer is exempted from the liability of costs incurred from the death, disability, or medical care of the insurant in any of the following circumstances:

...

(9) during the period in which the insurant develops AIDS or is being tested as HIV+;" ...

Being a PLWHA, I was deprived of the rights to compensation from the very beginning; neither can I decrease my loss as this contract is non-refundable and non-alterable.

I have been a PLWHA for 4 years, and I am in excellent physical and mental conditions. According to Joint Assessment Report of HIV/AIDS Prevention, Treatment and Care in China (2007), there were approximately 700,000 PLWHA across China by the end of 2007. The same report also states that PLWHA are as eligible to work, live, study, and have children as any average individual; PLWHA also have equal legal rights to participate in social and economic life as does every other citizen in the country.

There should be no stigma or discrimination against PLWHA according to the clauses of Law of the Peoples Republic of China on the Prevention and Treatment of Infections Diseases and Regulation on the Prevention and Treatment of HIV/AIDS; these regulations explicitly confirm and protect PLWHA's equal legal rights to social

participation by the Party and the Government during the strategic process of promoting harmonious community. Two clauses in Law of the Peoples Republic of China on the Prevention and Treatment of Infections Diseases and Regulation on the Prevention and Treatment of HIV/AIDS:

"There shall be no discrimination against PLWHA and their families by any institution or individual. PLWHA and their relatives have legally-protected rights in marriage, employment, health care, and education." (Clause No. 3, Chapter No. 1) "Local government, as well as subordinating authorities/institutions, shall organize prevention, treatment and care of HIV/AIDS, and shall carry out the publicity and education of non-discrimination against PLWHA and their families; it shall also create a nurturing and accepting social environment for treatment and prevention of AIDS by promoting a healthy lifestyle." (Clause No. 10, Chapter No. 2).

The injury and medical compensation of Jinzhufu (Golden Bless Card) for traffic accidents should be linked by no means to the nationality, race, sex, and history of disease of the insurant. There is no linkage between being HIV+ and the chance of encountering a traffic accident. Thus, if a PLWHA is unfortunately involved in a traffic accident, s/he is as eligible for compensation from an insurance company as anyone else. In medical senses, HIV/AIDS is merely one sort of infectious disease. Currently, there are 35 kinds of legally-reportable infectious diseases in three categories according to Law of the Peoples Republic of China on the Prevention and Treatment of Infections Diseases. HIV/AIDS is among the 22 infectious diseases in Category II, and there are more infectious diseases in Category I. Yet the contract of Ping'an Insurance Company of China excludes this PLWHA group of 700,000 from the shield of accidental insurance; in the mean time, by listing "During the period in which the insurant develops AIDS or is being tested as HIV+" as an equal condition to war, military operations, riot, armed rebellion, and nuclear radiation, this contract casts apparent prejudice and stigma, and severely harms the feelings to PLWHA. Furthermore, the contract also breaches the non-discrimination clauses in both Law of the Peoples Republic of China on the Prevention and Treatment of Infections Diseases and Regulation on the Prevention and Treatment of HIV/AIDS. In conclusion, the Accident Injury Insurance package of Ping'an Insurance Company casts audacious prejudice and stigma against PLWHA. Therefore, I request the deletion of discriminatory, illegal clauses from their insurance contracts. Until that happens, I hope that China Insurance Regulatory Commission effectively performs its supervising and monitoring duties against discriminatory contracts written by any insurance company. This will ensure legal rights for 700,000 PLWHA in China.
